1 · Acceptance of Terms

By accessing or purchasing from Kiwi Rockhound Gems, you agree to these Terms, our Privacy Policy, and Return & Refund Policy.
All transactions are governed by New Zealand law and, for Australian customers, by both New Zealand consumer law and the Australian Consumer Law (ACL) where applicable.

2 · Products and Services

We create and sell:

  • Hand-carved taonga, jewellery and sculptures made from authentic Aotearoa stones

  • Raw and polished crystals and collector specimens

  • Limited-edition Starship Line artworks

  • Educational and livestream content

Each piece is unique; natural variations in colour and texture are part of its authenticity and not considered faults.

3 · Pricing and Payments

  • All prices are listed in New Zealand Dollars (NZD) and include 15 % GST for NZ customers.

  • Australian orders are zero-rated for NZ GST and may be subject to Australian import GST or customs charges collected by Shopify Payments or the carrier under Australian Tax Office rules.

  • Accepted payments: Shopify Payments, PayPal, Afterpay, and bank transfer.

  • Payment processing is handled securely by Shopify (Level 1 PCI DSS compliant).

  • Prices may change without notice, but confirmed orders will always be honoured.

4 · Shipping and Delivery

  • NZ orders dispatch within 1–3 business days via NZ Post.

  • Australian orders deliver within 5–10 business days via tracked air courier (NZ Post International or Mainfreight).

  • All parcels include tracking and protective packaging.

  • Export sales are zero-rated for NZ GST and documented for compliance with NZ Customs and tax requirements.

5 · Returns and Refunds

Refunds and repairs are handled under the Consumer Guarantees Act 1993 for NZ buyers and the Australian Consumer Law (ACL) for Australian buyers.
Please see our full Return & Refund Policy for eligibility and time frames (14 days from delivery).
Custom or commissioned taonga are non-refundable unless found faulty.

6 · International Orders – Australia

  • Orders to Australia are shipped Delivered Duty Paid (DDP). The 10 % Australian GST and export processing cost are already included in your checkout price.

  • Where DDP is unavailable, customers are responsible for any import charges or GST applied at the border.

  • All Australian payments are processed in NZD; your bank may apply conversion or international transaction fees.

7 · Intellectual Property

All designs, images, text and livestream content are copyright © 2025 Kiwi Rockhound Gems.
The Starship Line and all related works are original creations and may not be copied, reproduced or used commercially without written permission.

8 · Cultural Integrity

Each taonga is created with respect for tikanga Māori and Ngā Taonga Tūturu principles.
We do not carve restricted materials without proper authority or consultation.

9 · Limitation of Liability

To the fullest extent permitted by law, Kiwi Rockhound Gems is not liable for any indirect or consequential loss arising from the use of our products or services.
Nothing in these Terms limits your rights under the CGA or ACL.

10 · Privacy and Data Security

Personal information is collected and used according to our Privacy Policy, which complies with the Privacy Act 2020 and Shopify’s international data-transfer safeguards.
Shopify may process data on servers located in Canada, the US or the EU under approved protection frameworks.

11 · Dispute Resolution and Governing Law

These Terms are governed by the laws of New Zealand.
For Australian customers, mandatory protections under the ACL also apply.
Any dispute will first be addressed through direct communication; if unresolved, it may be referred to the New Zealand Disputes Tribunal or Consumer Protection Service.
